Terms and Conditions

1. Service Description
WealthPoint is a technology-driven SaaS platform providing advanced analytical and portfolio consolidation services. WealthPoint explicitly does not provide investment advice, recommendations, or trade execution services. All provided data and analyses, including performance, risk assessments, cost evaluations, and allocation insights, are strictly for informational purposes only.

2. Subscription and Payments
WealthPoint services are accessible exclusively through quarterly or annual subscriptions, automatically renewed unless explicitly canceled before renewal:
Quarterly subscription: Minimum commitment of 3 months.
Annual subscription: 12-month commitment period.
New users can benefit from a one-month free trial. After this trial period, the subscription fee is automatically charged. Refunds are not available once payments are processed. Users may cancel subscriptions anytime, but commitments apply to the subscription periods already paid.

3. Data Providers and Accuracy
WealthPoint relies on third-party providers, specifically CBonds and Flanks, to obtain transaction and market data. Data synchronization occurs daily at 2:00 AM. WealthPoint implements quality control mechanisms for Time Series data but cannot guarantee or directly correct transaction data provided by third parties. Users acknowledge possible inaccuracies and agree that WealthPoint bears no liability for data provided by third-party sources.

4. Currency Exchange Valuations
WealthPoint offers currency conversion and asset valuation functionalities through provided exchange rates. However, WealthPoint does not guarantee the absolute accuracy or timeliness of exchange rates.

5. Data Security, Confidentiality, and Management
User data, including name, surname, email, phone number, portfolios, and transactions, are securely stored with encryption and strict separation between personal data and transactional data. Data is hosted by Infomaniak, a Swiss-based provider regulated by FINMA and not subject to the US Cloud Act.
Users have the right to delete their account or specific banking information anytime via their profile settings:
Removing a linked bank account immediately deletes related transaction data.
Closing the account permanently removes transaction data immediately. Personal data (name, email, phone) is retained for up to 6 months due to regulatory obligations, after which it is permanently deleted.
WealthPoint will immediately inform users via email in case of any data breach.

6. Liability and Disclaimers
WealthPoint explicitly states that it is purely an analytics platform and does not provide financial recommendations or investment advisory services. Users acknowledge and accept that WealthPoint cannot be held liable for financial losses or damages arising from inaccuracies, analytical errors, technical issues, or reliance on provided data. Users must seek professional financial, legal, or tax advice before making any financial decisions.

7. Account Suspension, Termination, and Non-payment
WealthPoint reserves the right to suspend or terminate user accounts immediately upon violation of these Terms and Conditions. If a user's payment fails, access to data and updates is suspended until the issue is resolved. There are no additional financial penalties imposed by WealthPoint for non-payment.

8. Intellectual Property and Proprietary Content
WealthPoint generates proprietary analyses, indicators, and personalized reports, constituting exclusive intellectual property protected by applicable laws. Users are prohibited from copying, exporting, or externally sharing this proprietary content. Exporting data or analyses in PDF, Excel, or via API is not currently permitted.

8 bis. Use of WealthPoint Branding and Logos
Any public use of WealthPoint's logos, trademarks, or branding materials requires explicit prior approval. Private or informal sharing of WealthPoint information among friends or personal networks is allowed without formal approval.

9. Cookies and Analytics
WealthPoint employs cookies exclusively for analytics (Google Analytics) and security purposes. Cookies are not used for advertising or performance tracking. Users can directly manage or disable these cookies through their web browser settings.

10. Regulatory Compliance and Jurisdiction
WealthPoint operates as a purely technological platform and is not regulated by any financial market authority. WealthPoint strictly adheres to data protection regulations, specifically Switzerland’s LPD and Europe’s GDPR.
In case of disputes, jurisdiction is determined as follows:
Default jurisdiction: Switzerland.
For Brazilian users, jurisdiction resides in Brazil, governed through WealthPoint's Brazilian entity.
For other European countries, jurisdiction is assigned to local courts in any country where WealthPoint maintains a formal entity.

11. Minors
WealthPoint explicitly prohibits usage of the platform by minors (individuals under the age of 18).
